[Remote] Legal Consultant, Municipal Disparity Study (1099, 30-hour scoped engagement)
Note: The job is a remote job and is open to candidates in USA. Tury Research Institute is seeking a legal consultant for a 30-hour engagement to advise on the constitutional-law framework for a municipal disparity study. The consultant will provide advisory services on legal standards, review findings, and assist in ensuring compliance with legal requirements for the City of Boston's Black Male Advancement Equity Study.
Responsibilities
- Advise TRI on what the post-Croson factual-predicate standard requires under Engineering Contractors Ass'n of South Florida v. Metropolitan Dade County and Concrete Works of Colorado v. City and County of Denver, then review TRI's disparity findings against that standard
- Flag any statistical evidence that would not meet the strong-basis-in-evidence threshold and identify what additional documentation the record needs
- Advise TRI on the narrow-tailoring criteria under Adarand Constructors v. Peña and Students for Fair Admissions v. Harvard as refined in Rothe Development v. Department of Defense, then review TRI's recommended remedies against those criteria
- Advise TRI on applying the outcome-statistics standard from Boston Parent Coalition for Academic Excellence Corp. v. School Committee of the City of Boston, then review TRI's race-neutral alternatives analysis
- Confirm the basis is documented in language suitable for a public-facing report
Skills
- JD and active law license. MA based
- Demonstrated expertise in disparity-study and civil rights law, specifically the Croson line of equal-protection cases governing race-conscious municipal programs
- Direct familiarity with the strong-basis-in-evidence and narrow-tailoring standards and their application to municipal disparity studies
- Ability to translate constitutional analysis into written work product usable in a public procurement record
- Prior work on municipal disparity studies or post-Croson statutory drafting
- Experience advising public agencies on race-neutral versus race-conscious remedy design
